Terms and Conditions
General
- Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
- The promoter is Link Foods Australia Pty Ltd, ABN 32 081 070 368, of Level 1, Suite 1.02, 2 Banfield Road, Macquarie Park NSW 2113, Australia (“Promoter”).
Eligibility
- Entry is only open to Australian and New Zealand (“NZ”) residents. Entrants under the age of 18 years must have the consent of their parent or legal guardian to participate, and the entry must be submitted in the name of, and include the full details of, the entrant’s parent or legal guardian.
- NZ residents must have a current valid passport to accept the Major Prize as defined below. The Promoter reserves the right to request and sight a NZ resident’s current valid passport before awarding the Major Prize.
- Employees (and their Immediate Family) of the Promoter and agencies associated with this promotion are ineligible to enter.
Promotional Period
The promotion commences at 12:01am AEDT on 12 January 2026 and ends at 11:59pm AEST on 28 April 2026 (“Promotional Period”).
Definitions
For the purposes of these Terms and Conditions:
Drawn Participant means a Participant whose entry is drawn in the Major Prize Draw, as per clause 9.
Immediate Family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
Major Prize Draw has the meaning in clause 10.
Participant means any eligible individual who submits a valid entry during the Promotional Period.
Player means the Drawn Participant who wins the Qualifying Activity and gets to play for the chance to win the Major Prize.
How to Enter:
- To enter, individuals must:
- Purchase a specially marked Jack Link’s product during the Promotional Period; and
- Follow the instructions on the promotional packaging; and
- After purchase, individuals must scan QR code from the promotional packaging or visit http://www.jacklinks.com.au/wtfpromo; and
- Follow the prompts to input requested details including the unique code (found within the specially marked product packaging), along with their personal details (Full name, Email Address, Age, Phone number, Postcode); and
- Guess the mystery flavour; and
- Submit a fully completed entry during the Promotional Period to be deemed valid.
- A maximum of ten (10) entries per person per day is accepted and permitted. Up to five thousand (5,000) unique codes will also be shared via influencer and social network, enabling entry without purchase.
- Incomplete or indecipherable entries will be deemed invalid, at the Promoter’s discretion.
Verification
- The Promoter reserves the right, at any time, to verify the validity of entries and Participants (including a Participant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
- If there is a dispute as to the identity of a Participant, the Promoter reserves the right, in its sole discretion, to determine the identity of the Participant. The Promoter may request supporting documentation such as a Participant’s Australian or NZ valid Driver’s License.
- For entries with purchase, the Participant must retain original qualifying purchase barcode/s as proof of purchase for all entries. If a Participant is selected as a Drawn Participant and cannot produce proof of purchase for the entry drawn, the Promoter may, at its discretion, disqualify all entries submitted by that Participant. Proof of purchase must be identical to that provided on the entry.
- If, in the Promoter's reasonable opinion based on the available information, you have shared any proof of purchase with another person, your entries will be invalid, and you will lose any right to a prize.
Major Prize Draw
- All valid entries received during the Promotional Period will be placed into a Major Prize Draw (“Draw”) held at the Promotional Partners office at MDSA, Level 16, 1 Denison Street, North Sydney NSW 2060 on 30 April 2026, at 10:00am (AEST).
- The first three (3) eligible entries drawn, in the Draw will be deemed “Drawn Participants”. If a Drawn Participant is under 18 years of age that entrant’s nominated parent or guardian will participate in the Qualifying Activity on behalf of the eligible entrant.
- The three (3) Drawn Participants will be required to participate in an elimination style preliminary activity ("the Qualifying Activity") in order to determine which Drawn Participant will take part in the Game for the chance to win $1,000,000 AUD ("Major Prize").
- The three (3) Drawn Participants will be notified in writing within two (2) business days of the outcome of the Draw and their first initial, surname and postcode will be published at www.jacklinks.com.au/wtfpromo from 4 May 2026 for at least thirty (30) days – the opportunity to play the Qualifying Activity and then Game (pending outcome of the Qualifying Activity) must be accepted by 5:00pm (AEST) on 14 May 2026. If the winning Drawn Participant is under 18 years of age, that entrant’s nominated parent or guardian will participate in the Game on behalf of the eligible entrant. Any prize won will be awarded to the eligible entrant’s nominated parent or guardian on behalf of the winner.
- If an opportunity to play in the Qualifying Activity remains unclaimed or forfeited by any of the Drawn Participants through ineligibility or otherwise by 14 May 2025, the Promoter will conduct a further Draw, as required, at the same time and place as the original Draw on 15 May 2026.
- The new Drawn Participant/s, if any, will be notified by phone and in writing. Their first initial, surname and postcode will be published at www.jacklinks.com.au/wtfpromo from 15 May 2026, for a minimum of 30 days.
- The new Drawn Participant/s will have the same opportunities as outlined in clause 10.
If a Drawn Participant is unable to attend the Game, they may appoint a proxy aged eighteen (18) years and above to participate in the Game on their behalf. A signed written notice must be provided to the Promoter no later than 18 May 2026. If the Drawn Participant is unable to appoint a proxy, a representative will be appointed by the Promoter to participate in the Game on the winner’s behalf.
- Filming and Content Distribution Consent
By accepting selection as one of the three (3) participants/winners eligible for the chance to win AUD $1,000,000, each participant (or their nominated parent or guardian) irrevocably acknowledges and agrees that they may be filmed, photographed, recorded and otherwise captured in audio and visual form during any aspect of the promotion, competition, or related activities. Each participant grants the promoter and its related entities a perpetual, worldwide, royalty-free, irrevocable and transferable license to use, reproduce, edit, modify, adapt, publish, communicate, transmit, broadcast and otherwise distribute such recordings, images and content, in whole or in part, in any format or medium now known or later developed, including but not limited to digital, online, social media, streaming and other electronic media channels, for promotional, marketing, publicity and related purposes, without further notice, consent or compensation. To the extent permitted by law, each participant (or their nominated parent or guardian) waives any moral rights and similar rights in connection with such use.
Prize Details
- All Drawn Participants will be required to attend the Qualifying Activity and Game that will take place on either 30 May 2026 - 31 May 2026 in Casino, NSW Australia, as determined by the Promoter and published online at www.jacklinks.com.au/wtfpromo by 8 May 2026.
- Drawn Participants residing outside a 200km radius of Casino, NSW will receive:
- Two (2) return economy airfares from their nearest capital city in Australia or New Zealand to Ballina Byron Gateway Airport (flight associated taxes are included); and
- Two (2) nights twin share accommodation at a minimum 3 star hotel determined by the Promoter; and
- Return airport transfers;
All valued at up to $5,000 AUD depending on point of departure (“Travel Prize”).
- Drawn Participants and their companion must depart from and return to the same departure point and travel together, and may be required to present their credit card at time of accommodation check in.
- Changes to travel dates and/or accommodation after booking confirmation are not permitted.
- The Promoter takes no responsibility for missed connections, flights and mishaps while undertaking the prize, lost baggage or person or property mishaps. All travel will be booked by the agency specified by the Promoter and is subject to availability.
- If a Drawn Participant resides within a 200km radius of Casino NSW, and elects to participate in the Game, they will be responsible for transport to and from the Game, accommodation, and will forfeit the Travel Prize. No compensation will be paid or given in lieu.
- Except as detailed in these Terms and Conditions, the Travel Prize excludes spending money, meals, taxes (excluding airline and airport taxes), insurance, transport to and from the departure point, transfers, items of a personal nature (including but not limited to in-room charges) and all other ancillary costs. Where applicable, any travel or entry documentation and arrival fees are the responsibility of the winner and their travel companion. It is the winner’s responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the winner and their guest. If for any reason the winner is unable to accept the Prize as stated, and/or within the date indicated, the winner will forfeit that Prize and no compensation will be given in lieu.
- In the event that the Promoter has not been able to contact the Drawn Participant before the start of the Game, a representative of the Promoter will play the Game on the Participant behalf.
Qualifying Activity
- 24.A Qualifying Activity will take place, with the three (3) Drawn Participants taking part in the Qualifying Activity which will eliminate two (2) Drawn Participants where only (1) Drawn Participant will win and proceed to participating in the Game.
- 25.The Qualifying Activity will take place immediately before the Game. The one (1) Drawn Participant to successfully ’win’ against the other two (2) Drawn Participants, based on the result of the Qualifying Activity will have the opportunity to take part in the Game (“the Player”).
- The specific mechanics of the Qualifying Activity, including requirements to ‘win’, will be revealed to Drawn Participants by 18 May 2026. The two (2) Drawn Participants who do not proceed to play in the Game will each be awarded a Cash Prize of $5,000 AUD. The Cash Prize will be transferred to their nominated bank account within thirty (30) business days of the Drawn Participant providing their Bank Details.
- The order of play for the Qualifying Activity will be determined by the order in which the Drawn Participants were drawn. The first Drawn Participant will play first, the second Drawn Participant will play second, and the third Drawn Participant will play third.
The Game
- The specific mechanics of the Game will be revealed to the Drawn Participants by 18 May 2026. While the exact details will be revealed closer to the event date, the Game will be conducted in a fair and transparent manner, ensuring all Contestants have an equal opportunity to win.
- The Player (i.e. the Drawn Participant to ‘win’ the Qualifying Activity) will be the only person to attempt the Game and have the chance to play to win $1,000,000 AUD prize. If the Player does not win the Major Prize the Player will be awarded a guaranteed Consolation Prize of $5,000 AUD. The Major Prize OR Consolation Prize will be transferred to their nominated bank account within thirty (30) business days of the Player providing their Bank Details.
- The odds of winning the $1,000,000.00 AUD prize during the Game are 1 in 100. The odds of being drawn as a Drawn Participant may be significantly higher than the odds of the Player winning the Major Prize and will depend on the total number of valid entries received during the Promotional Period.
- The total prize pool value is up to $1,025,000.00 AUD (Major Prize, Elimination Consolation Cash Prizes and Travel Prizes).
- If for any reason the Player of the Game does not redeem their Major Prize (or any component of the prize) by the time stipulated by the Promoter, that prize (or component) will be deemed forfeited. No compensation will be provided in lieu of any forfeiter prize or prize element.
General
- Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise stated in these Terms and Conditions.
- By entering this promotion, Drawn Participants consent to the Promoter using their name, likeness, image and/or voice (including photographs, film and/or recordings) in any media for an unlimited period without remuneration, for the purpose of promoting this promotion (including its outcome), and promoting any products manufactured, distributed or supplied by the Promoter.
- If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
- to disqualify any Participant; or
- subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
- Any cost associated with accessing the promotional website are the responsibility of the Participant and depend on the Internet service provider used.
- Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its directors, respective officers, employees and agents) excludes all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the promotion.
- Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its directors, respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
- any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
- any theft, unauthorised access or third party interference;
- any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
- any tax liability incurred by a winner or Participant; or
- participation in or use of a prize.
- As a condition of accepting the prize, the winner may be required to sign legal documentation in the form required by the Promoter in their absolute discretion, including but not limited to a legal release and indemnity.
- The Promoter reserves the right to request winners to provide proof of identity and/or proof of purchase. Failure to produce proof of identity and/or proof of purchase when requested may, in the absolute discretion of the Promoter, result in invalidation of all of a Participant’s entries and forfeiture of any right to a prize.
- The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers (including Jack Link’s) and, where required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.jacklinks.com.au/privacy-statement.In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the Participant. The Privacy Policy also contains information about how Particpants may opt out, access, update or correct their PI, how Participants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
- Unless specified otherwise, the Promoter may disclose Participant’s personal information to any entity outside of Australia.
- These Terms and Conditions are governed by the laws of the relevant state/territory jurisdiction in Australia. Each Participant submits to the non-exclusive jurisdiction of the courts of the relevant state/territory jurisdiction, Australia.
